WARRANTY CONDITIONS

NOTICE OF DEFECTS AND WARRANTY

TAVSAN warrants product(s) against defects in materials, manufacturing, and workmanship for a period of 1 year from the date of delivery according to the terms listed below. Electronic products are under warranty during tests and defects are replaced at that time. After that the warranty period is voided.

  1. If not sold as EXW delivery, all shipments will be inspected by the recipient for visible, identifiable transport damage at the time of acceptance. All damages, if any, must be recorded on the appropriate transport document (consignment note, delivery note). This document must be signed by the forwarding agent as well. A copy of this transport document with the comments about the alleged faults must be emailed to us in 24 hours.
  2. A further examination of the visible quality and the condition of the goods must take place without delay on receipt and after unloading of the goods. Defects or mistaken quantities must be reported in writing without delay upon discovery (within 24 hours). The customer must photograph visible defects in quality.
  3. All received goods must be unloaded using appropriate equipment such as forklifts, vehicles etc. After the loading, the goods must be stored in an appropriate protective location (depot, storage facilities…etc.) against weather, theft and all other unforeseen damages. Any damages occurred due to not following these steps will not be covered by the warranty.
  4. Provided that the assembly is not carried out by us, hidden defects in quality, which were not discovered within the time limit even upon careful inspection, must be notified to us in writing immediately upon their discovery (within 7 days).
  5. Equivalent legal consequences to the inspection occur, if the purchaser allows a time limit set by us for inspection to lapse.
  6. Written notification of defects must include the following information:
    • The date of the determination of the defect,
    • A description of the defect found,
    • An exact description of the method of transport (identification number of the container – or lorry – in which the goods were delivered in, or alternatively in cases of “EXW deliveries”, the identification number which the purchaser used to collect the goods).
  1. If a claim is justified and made within the time limit, we may at our discretion, either repair the defect or replace the defective goods (subsequent performance). All claims under this warranty will be invalid if the purchaser does not immediately give us (or someone appointed by us) the opportunity to verify the alleged defect on site and in particular does not present the goods immediately on our request.
  2. All TAVSAN materials must be used according to the given instructions and the purpose of the specific product. Damages caused by misuse and mishandling of the products will not be covered by the warranty.
  3. Products that have not been purchased and supervised by authorized TAVSAN dealers/sellers and/or found to be damaged upon inspection due to wrong assembly and misuse will not be covered by the warranty.
  4. All changes made on TAVSAN products without a prior written permission by TAVSAN will cause the warranty to be invalid.
  5. This warranty does not cover any electrical components. If any, the warranty of these components will be covered by the appropriate producer of the specific product.
  6. In the case of a fault/breakdown, only an authorized Tavsan personnel must repair the materials. Damages due to the repairs done by unauthorized persons will not be covered by the warranty.
  7. Disposable products (such as belts, gaskets, etc.) that no longer work due to natural wear and tear will not be covered by the warranty. Wear and tear is damage that naturally and inevitably occurs as a result of normal use. Replacements for such materials will be sold on request.
  8. Tavsan warranty does not cover any loss of time, loss of work, loss of livestock, loss of feed, and any other losses occurred as a result.
  9. This warranty is only valid if the products are solely used for poultry. The use of Tavsan products for the purpose of any other industry or trade will cause the warranty to be void.
  10. Any related costs (transportation, assemble, travel expenditures) that occur as a result of warranty covered replacements will not be part of the warranty coverage.
  11. Damages due to the consequences of natural disasters such as lightning, flood, earthquake, fire, etc. or any other unforeseeable circumstances will not be covered by the warranty.
